Terms of Service

Agreement & Rights
By purchasing my work the commissioner signifies that they understand and agree to the following Terms of Service in their entirety. I will make any edits to these terms publicly known and will notify anyone with an open commission of any changes. Commissioners are subject to any and all changes made to the ToS during the time they are working with me.I reserve the right to change the ToS at any time.
I reserve the right to deny any commission.Payment
Payment(in USD) is through PayPal only. Once provided with the commissioner's PayPal linked e-mail, I will send an invoice for the agreed upon price. By verifying and submitting payment you agree to this ToS. Payments under $100 must be paid in full before work begins.I will not accept any crypto-currency of any kind.Refunds
Commissioners are entitled to ask for a refund at any time and are not required to provide a reason. Full refunds will only be issued if work has not yet begun. If work has already begun, only a partial refund will be given.If I, for any reason, find myself unable to complete a commission, a refund will be issued in full.Re-posting
Commissioners may re-post the finished work on personal sites or blogs(FA, dA, TH, tumblr etc.) only if proper credit is provided. The post must include my username, a link back to one of my accounts(@ponpoe on most sites), and must somehow clearly state that the piece was drawn by me.Any posted artwork must include some form of watermark, whether your own or mine. I will provide a watermarked version for posting upon request.Editing
By Commissioner - Commissioner may not edit the image file in anyway including, but not limited to: color-shifting, detail tweeking, adding details, clothes or accessories etc. Any and all edits must be done by myself. Exceptions include cropping the image for use in icons and thumbnails or re-sizing for re-post(I often re-size the image to acceptable posting size myself so additional resizing is usually unnecessary).By Myself – During the drawing process, a commissioner may be shown updates on their piece and view its progress. If they feel edits are required, they may bring them up anytime while the work is in progress. Edits requested during the “sketch” phase are free. For works that extend beyond this phase, commissioners will begin to be charged an “Edit Fee”. Once the clean lines and/or color have been added, Edit Fees are $2 for a minor edit and $5 for a major edit. If the commissioner requests edits any time after the work has been completed(limit 7 days), they will be charged a fee $5 for a minor edit and $10 for a major edit(fee prices in USD). Degree of edits are up to my own discretion.Use
Any and all commissions purchased are for commissioner's PERSONAL USE only. Image cannot, in any way, be used for commercial use or to gain profit of any kind. Personal use includes but is not limited to: posting art in personal and character galleries, cropping for icons and thumbnails, and printing(prints, stickers, buttons, shirts etc).Copyright
I maintain all rights to my work and can use images for promotional and other purposes.Failure to comply to these terms will result in commission cancellation or revocation with or without refund under my discretion.Project Turn-Around
Unless a specific deadline is discussed and set, please allow for at least a 60 days(~2 months) for completion.The commissioner will be contacted if, for any reason, the piece is expected to take longer than 60 days or must be delayed. It is up to the commissioner whether they are willing to wait or if they would like to receive a full or partial refund.If the allotted 60 days have passed without contact, a full or partial refund may be given depending on what amount of work, if any, has already been done.Any commission of a character that doesn't have an established, drawn reference will be considered a character design. Acceptable references are pieces drawn by yourself or other artists of the character.NSFW/Adult-themed Work
By submitting payment, you verify that you are 18 years of age or older. If it is uncovered that you are not of legal age, work will be terminated, commission revoked, and no refund given. In addition, you will be barred from all future business.DO NOT under any circumstances allude to or remark on the nature of your commission when paying the PayPal invoice.
